Disclosure reports in accordance with the German Banking Act (KWG) and Capital Requirements Regulation (CRR) no longer required
Having given consideration to the particular business models of promotional banks, the German legislature has exempted such credit institutions, which are listed in Article 2 (5) Number 5 of Directive 2013/36/EU, from implementing disclosure regulations set out in section 26a KWG and Articles 431 to 455 of Regulation (EU) No 575/2013, by inserting a new addendum – in the form of paragraph (9)i – to section 2 KWG with effect from 29 December 2020. Under European law, the disclosure requirement in accordance with Regulation (EU) No 575/2013 for the aforementioned credit institutions, of which Landwirtschaftliche Rentenbank is one, has already been abolished with the entry into force of Directive (EU) 2019/878 as at 27 June 2019. Landwirtschaftliche Rentenbank will therefore no longer be producing a disclosure report in the sense of section 26a KWG and Articles 431 to 455 of Regulation (EU) No 575/2013.
